Equal Representation Act

This bill mandates significant changes to the decennial census process starting in 2030. It requires the inclusion of a checkbox or similar option on the census questionnaire for respondents to indicate whether they, and each member of their household, are United States citizens . Furthermore, the Secretary must publicly release, within 120 days of census completion, the number of individuals per state, disaggregated by citizens and noncitizens. Crucially, the bill amends existing law to exclude noncitizens from the population count used to determine the apportionment of Representatives in Congress and, by extension, electoral votes. This change will take effect for the 2030 decennial census and all subsequent censuses, ensuring that congressional representation is based solely on the citizen population.
