This bill amends the Grand Ronde Reservation Act to address the hunting, fishing, trapping, and animal gathering rights of the Confederated Tribes of the Grand Ronde Community. It specifies that the existing Grand Ronde Hunting and Fishing Agreement will remain in effect unless replaced or modified by new government-to-government agreements between the Tribes and the State of Oregon. Any such successor agreements can be amended by mutual consent. However, these new or amended agreements are explicitly prohibited from affecting the ancestral, aboriginal, treaty, or other rights of the Grand Ronde Community or any other Indian Tribe. Furthermore, any hunting, fishing, trapping, and animal gathering rights established in successor agreements must derive solely from the authority of the State of Oregon . The bill also allows for judicial review of a 1987 Consent Decree in the U.S. District Court for the District of Oregon, specifically waiving the defenses of res judicata and collateral estoppel. Finally, it clarifies that nothing in the bill or subsequent agreements should be interpreted to define, limit, or affect any Indian Tribe's treaty or sovereign rights.
