This bill requires the Federal Motor Carrier Safety Administration (FMCSA) to implement a national employer notification service for commercial driver's license (CDL) holders. Within one year of enactment, the FMCSA must issue a final regulation for this service, which will automatically provide employers with reports on changes to an employee's driving record, including convictions, accidents, or license suspensions. Before implementation, the FMCSA must consider recommendations from the American Association of Motor Vehicle Administrators (AAMVA) and the findings of a 2007 pilot program. States will be required to utilize this service within two years of the regulation's issuance, and it will become an enforceable part of the commercial driver license program. The bill specifically mandates participation for employers with employees holding a school bus endorsement , defining schools and school districts as employers for this purpose, even if they contract private transportation. Employers participating in the service will be exempt from annual driving record inquiry requirements, and employees will receive simultaneous notification and a copy of any report furnished to their employer.
