This bill, known as the "Miranda Vargas School Bus Driver Red Flag Act" or "Miranda's Law," requires the Federal Motor Carrier Safety Administration (FMCSA) to implement a national employer notification service. This service will automatically provide employers with reports on changes to the driving records or license status of their employees who hold a commercial driver's license (CDL). Such changes include convictions for moving violations, failures to appear, accidents, and license suspensions or revocations, aiming to keep employers informed of their drivers' current eligibility. The FMCSA must issue a final regulation within one year, considering recommendations from the American Association of Motor Vehicle Administrators (AAMVA) and results from a 2007 pilot program. States are then required to utilize this service within two years of the regulation's issuance, with the Secretary of Transportation integrating it into commercial driver license program requirements. Employers with employees holding a school bus endorsement on their CDL must participate, and participating employers will be exempt from annual driving record inquiry requirements. Furthermore, drivers will receive simultaneous notification and a copy of any report furnished to their employer, and school districts are explicitly defined as employers under this service.
