The "Hotel Fees Transparency Act of 2025" seeks to prevent unfair and deceptive advertising practices related to prices for hotel rooms and other short-term lodging. It makes it unlawful for covered entities, including hotels, short-term rentals, and third-party online sellers, to display or advertise a price that does not clearly, conspicuously, and prominently show the total services price . This total price must be disclosed at the time services are first displayed and throughout the purchasing process, with government-imposed taxes and fees also disclosed prior to final purchase. The bill clarifies that while the total services price must be most prominent, individual components of the total price can still be displayed. Enforcement of these provisions will be carried out by the Federal Trade Commission (FTC) , treating violations as unfair or deceptive acts or practices. Additionally, State Attorneys General are authorized to bring civil actions on behalf of their residents, with provisions for notifying and allowing intervention by the FTC. An affirmative defense is provided for intermediaries or third-party online sellers who relied in good faith on inaccurate price information from hotels and promptly corrected it upon notice. The legislation also includes preemption clauses, preventing states from maintaining laws that conflict with its fee disclosure requirements, unless those state laws align with the Act's definition of total services price. The prohibition on deceptive advertising will take effect 450 days after the bill's enactment.
