This legislation establishes rigorous vetting standards for individuals sponsoring unaccompanied alien children (UACs) before they are released from federal custody. The prospective sponsor and all adult household members must undergo a comprehensive vetting process, in consultation with relevant state and federal agencies. This process includes a fingerprint background check , public records check, National Sex Offender Registry check, FBI National Criminal History check, State-level Child Abuse and Neglect check, and local criminal history checks. The bill prohibits the placement of UACs with sponsors who are unlawfully present in the United States, unless they are a biological parent, legal guardian, or relative of the child. It also mandates significant monitoring, requiring a pre-release home visit to the proposed household. After release, the Secretary of Health and Human Services must conduct at least five unannounced in-person home visits during the first year and quarterly visits during the subsequent year. Furthermore, the Act requires immediate retroactive vetting for all sponsors who have received a child since January 20, 2021, ensuring all past placements meet the new standards. The Secretary of Health and Human Services and the Secretary of Homeland Security must also submit monthly reports to Congress. These reports detail various metrics, including the number of UACs encountered, sponsor background checks, home visits completed, and efforts to account for children reported missing or for whom no record exists since their release.
