Under this legislation, a state will face penalties if it either issues a driver's license to an individual who lacks proof of United States citizenship or lawful presence, or if it prohibits state or local entities from sharing immigration enforcement information with the Department of Homeland Security. This information includes details on citizenship status and release dates from detention facilities. The penalties include the requirement for non-compliant states to return any unobligated Byrne JAG funds within 30 days of the triggering action. Furthermore, such states will become ineligible to receive future Byrne JAG funds until they implement laws or policies that prohibit issuing driver's licenses to individuals without lawful presence and permit the unrestricted sharing of immigration enforcement information with federal authorities.
