This bill, titled the "Restoring Biological Truth to the Workplace Act," amends Title VII of the Civil Rights Act of 1964 to prohibit employment discrimination based on an employee's expression concerning the binary or biological nature of sex. This protected "covered expression" includes speech, writing, depictions, and the use of pronouns, both inside and outside the workplace. The legislation also makes it an unlawful employment practice for employers to take adverse action against an employee for requesting or using a single-sex area , such as a bathroom or changing facility, where physical privacy is desired. Importantly, the bill specifies that neither job relatedness nor business necessity can serve as a defense for such discriminatory practices. Additionally, it strengthens existing protections by prohibiting employers from retaliating against employees who engage in these newly protected activities.
