This legislation amends Title VII of the Civil Rights Act of 1964 to introduce new prohibitions against employer discrimination. It specifically makes it an unlawful employment practice for an employer to take adverse action against an employee for engaging in expression that describes, asserts, or reinforces the binary or biological nature of sex . This protected "covered expression" includes speech, writing, depictions, and the use of pronouns, applicable both inside and outside the workplace. Furthermore, the bill prohibits discrimination against an employee for requesting or using a single-sex area , such as a bathroom or changing facility, where physical privacy is desired. The legislation explicitly states that job relatedness or business necessity cannot be a defense for these discriminatory practices and also prohibits retaliation against employees who engage in these protected activities.
