The "American Food for American Schools Act of 2026" aims to strengthen the "Buy American" requirements within the Richard B. Russell National School Lunch Act. It expands the application of these requirements beyond the school lunch program to include the summer food service program , the child and adult care food program , the special milk program , and the school breakfast program . The bill also clarifies the definitions of "domestic commodity or product" to include U.S.-produced agricultural goods, U.S.-processed foods, and specific U.S.-harvested fish or seafood. The legislation introduces a more stringent waiver process for school food authorities (SFAs) seeking to purchase foreign commodities or products. SFAs must now request a waiver from the Secretary of Agriculture, with exceptions only for products not domestically available in sufficient quantities or quality. These waivers are limited to 5 percent of total annual commercial food costs within each food component. To enhance transparency, the Secretary is mandated to establish and maintain a publicly available list of all granted waivers on the USDA website, detailing the SFA and specific food products involved. The bill also imposes new reporting requirements, obligating SFAs to notify parents annually about foreign products purchased and to report to State Educational Agencies (SEAs) on foreign products bought without a waiver. SEAs, in turn, must compile and submit these reports to the Secretary. Furthermore, contracts between SFAs and suppliers must include a provision ensuring compliance with "Buy American" rules, with non-compliant suppliers required to reimburse federal funds. The Secretary will also publicly list instances of noncompliance reported by SEAs. Finally, the Act reauthorizes and significantly increases funding for the Buy American Procurement Training Program , raising the annual authorization from $1,000,000 to $5,000,000 for fiscal years 2026 through 2031. This aims to improve compliance with domestic sourcing requirements by providing enhanced training and resources.
