The "China-Africa Mining Transparency Act" mandates the Secretary of State to annually compile and publicly release a list for five years. This list will identify People's Republic of China-origin entities engaged in mining activities in specific African nations, including the Democratic Republic of the Congo, Nigeria, Guinea, Zambia, South Africa, and Zimbabwe. The mining activities covered include both large-scale and artisanal and small-scale operations extracting critical minerals, gold, or iron. Entities are listed if they are found to be using forced labor or causing environmental harm to a protected area during their mining operations. The list will also specify the particular mines, mining zones, or concessions involved. To develop this list, the Secretary will utilize open-source information and consult with various U.S. government agencies, such as the Departments of Labor, Commerce, and Treasury, as well as foreign country counterparts.
