To protect collective self-determination and individual rights under Federal statutes conferring nationality on persons born and residing in the territory of American Samoa, to enable subsequent elective United States citizenship upon application of such persons residing in a State or in a territory subject to sections 301 through 308 of the Immigration and Nationality Act, and for other purposes.
This bill revises the Immigration and Nationality Act to establish a new process for United States nationals to obtain passports and, in certain cases, elect for U.S. citizenship. Specifically, it amends Section 341(b) to allow individuals who are nationals but not citizens to apply for a U.S. passport identifying them as such. Crucially, for nationals residing in a State or a territory subject to sections 301 through 308 of the INA, the bill enables them to apply for a passport that identifies them as both a national and a citizen of the United States , effectively providing an elective path to citizenship. This change streamlines the process by repealing Section 325 of the INA, which previously addressed nationals becoming citizens upon application. Conforming amendments are also made to the section header and table of contents to reflect these changes, renaming Section 341 to "procedure for passports for U.S. non-citizen nationals."
