The Training Assignments for Student Knowledge Act, or TASK Act, proposes to amend the Fair Labor Standards Act of 1938. Its primary purpose is to clarify that certain individuals performing tasks and services within postsecondary vocational institutions are not to be treated as employees under the Act. Specifically, the bill adds a new clause to the definition of "employee" in the FLSA. This clause excludes any individual who performs tasks and services required by a postsecondary vocational institution to obtain a recognized postsecondary credential . This amendment would mean that students engaged in such activities would not be subject to federal minimum wage, overtime, and other employment protections typically afforded to employees.
