This bill aims to allow certain military disability retirees to receive both their full military retired pay and veterans' disability compensation without reduction. Specifically, it targets individuals whose disabilities are combat-related , addressing a long-standing issue where these benefits are typically offset against each other. The legislation seeks to ensure that those who incurred severe injuries in service, particularly in combat, are fully compensated for both their service and their disability. The bill amends Title 10, United States Code , by modifying sections 1413a and 1414. These amendments explicitly state that the retired pay of disability retirees with combat-related disabilities will not be subject to reduction due to veterans' disability compensation. This means eligible service members will no longer see their retired pay decreased by the amount of disability compensation they receive from the Department of Veterans Affairs. Furthermore, the legislation includes several technical and conforming amendments to update existing statutes. These changes reflect the conclusion of previous concurrent receipt phase-in periods and ensure consistency within the law. The provisions of this act are slated to become effective on the first day of the first month after its enactment, applying to all payments made from that date forward.
