The comprehensive review will cover various aspects, including the economic impact of FDI on U.S. jobs and industries, global investment trends, and existing federal policies that facilitate FDI attraction. It will specifically analyze the unique challenges posed by FDI from State-owned or State-backed enterprises , particularly those influenced by the Chinese Communist Party, and explore how other trusted nations address such investments. The review will also consider the impact of protectionist policies by other countries, such as data localization rules and intellectual property infringement, on U.S. advanced technology and competitiveness. Before and after conducting the review, the Secretary must provide opportunities for public comment on the matters covered and the proposed findings. Within one year of enactment, a detailed report will be submitted to Congress, outlining the review's findings and offering recommendations to increase U.S. global competitiveness in attracting FDI. These recommendations must also ensure the strengthening or maintenance of U.S. security, labor, consumer, financial, and environmental protections, explicitly excluding matters related to the Committee on Foreign Investment in the United States (CFIUS).
