This bill aims to amend the Social Security Act to provide retirement security for United States nationals who were unlawfully or wrongfully detained or held hostage abroad. It introduces a new section to deem periods of captivity as "qualifying months" for Social Security purposes. A "qualifying individual" is defined as a U.S. national whose detention or hostage status has been officially determined by relevant federal authorities, such as under the Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act or by the Hostage Recovery Fusion Cell. During these qualifying months , individuals will be credited with "deemed wages" equal to one-twelfth of the national average wage index for the preceding year, up until retirement age. These deemed wages will be used to determine their entitlement and the amount of any monthly Social Security benefits or lump-sum death payments, ensuring their time in captivity does not diminish their retirement security. The Commissioner of Social Security is mandated to issue regulations within one year, and individuals must submit an application with federal documentation of their detention or hostage status to receive these benefits, which will take effect 24 months after enactment.
