The "Born-Alive Abortion Survivors Protection Act" amends title 18 of the United States Code to ensure that infants born alive after an abortion or attempted abortion receive appropriate medical care. Congress finds that such infants are legal persons entitled to all protections under U.S. law, similar to any other newborn. Therefore, any health care practitioner present must exercise the same degree of professional skill, care, and diligence to preserve the child's life and health as they would for any other child born alive at the same gestational age, and ensure the child is immediately transported and admitted to a hospital . Failure to comply with these requirements can result in significant penalties , including fines, imprisonment for up to 5 years, or both. Furthermore, intentionally performing an overt act that kills a child born alive under these circumstances will be punished as homicide. The bill also mandates that any healthcare practitioner or facility employee with knowledge of a violation must immediately report it to an appropriate State or Federal law enforcement agency. Additionally, the woman upon whom the abortion was performed or attempted may pursue civil remedies , including monetary, statutory, and punitive damages, against any person who committed a violation, while mothers are explicitly protected from prosecution under this section.
