ADVERSARIES Act

This bill requires the Under Secretary of the Bureau of Industry and Security, through the Executive Director of the Office of Information and Communications Technology and Services (OICTS), to conduct a comprehensive review within 90 days of enactment. The primary purpose of this review is to analyze the impact on United States export control effectiveness and national security threats posed by foreign adversary access to controlled items within the United States. Specifically, it will examine the operations of U.S.-domiciled affiliates of entities on the Entity List or Military End User List. The review must determine if these affiliates, defined as being 50 percent or more owned by sanctioned entities, can acquire items that their ultimate parent companies are restricted from accessing due to U.S. export controls. If so, it will assess the extent of such acquisitions and their impact on the effectiveness of U.S. export controls. Additionally, the analysis will identify risks to national security or export control effectiveness posed by foreign-adversary controlled information and communications technology and services (ICTS) , including whether specific sectors present undue risk. Upon completion, the Under Secretary and OICTS Executive Director must outline any steps they intend to take within the next year to address the identified threats and recommend any necessary changes to U.S. law. The results of this review must be provided to the House Committee on Foreign Affairs and the Senate Committee on Banking, Housing, and Urban Affairs within 30 days of its completion.
