The "Fast Tracking European Investment in Ukraine's Defense Act" aims to expedite the transfer of critical defense articles to Ukraine by amending the Arms Export Control Act. This legislation encourages long-term investment in the U.S. defense industrial base from allies and partners, while also facilitating increased international contributions to Ukraine's defense against the ongoing Russian invasion. The bill establishes a process for pre-approving the purchase and third-party transfer of specific defense articles to the Government of Ukraine, bypassing certain standard requirements of the Arms Export Control Act. This streamlined approval applies when the purchaser is a NATO member country, Australia, Japan, South Korea, Israel, or New Zealand, and the recipient is Ukraine. The eligible defense articles are specifically 155mm artillery shells , 155mm Excalibur extended range artillery shells , High Mobility Artillery Rocket System (HIMARS) munitions , and Guided Multiple Launch Rocket System (GMLRS) munitions . Ukraine must provide a written commitment not to retransfer these articles without the U.S. President's consent and accept them by December 31, 2030, a deadline which the Secretary of State can extend annually until December 31, 2035, if Russia's invasion continues. The President must promptly notify Congress before any such transfer is made.
