American Hiring Transparency Act

The American Hiring Transparency Act establishes a new fee for employers seeking permanent labor certification to hire foreign workers. This fee, which is in addition to existing charges, will be at least $10,000 in fiscal year 2027 and will be subject to annual inflation adjustments thereafter. Employers filing an Application for Permanent Employment Certification (Form ETA 9089) or similar forms will be required to pay this non-waivable fee at the time of application.

The collected fees will be divided, with 50 percent deposited into the general fund of the Treasury and the remaining 50 percent directed to a newly established PERM Fee Account. Funds from this account will be further split: half will be made available to the Secretary of Labor for expenditure without further appropriation, and the other half will go to the Director of the Office of Personnel Management. These OPM funds are specifically designated for upgrading and maintaining the USAJOBS website to enhance its capabilities for hosting job advertisements and processing applications, thereby facilitating labor market testing.
