The penalties are significantly enhanced if the evasion results in harm: if serious bodily injury occurs, the offender faces 5 to 20 years imprisonment, and if death results, the penalty is 10 years to life imprisonment. Furthermore, the bill amends immigration law to make any alien convicted of, or admitting to, this offense inadmissible to the U.S., deportable, and ineligible for any form of immigration relief, including asylum. The Attorney General is also required to submit an annual report detailing statistics related to this new offense, including charges, apprehensions, and penalties imposed.
