This legislation significantly expands access to dental and oral health services for adults under Medicaid. It mandates that states provide comprehensive dental and oral health coverage for adults, including medically needy individuals, starting January 1, 2028. The bill broadly defines these services to encompass dentures, implants, preventative care, restorative treatments, pain reduction, and emergency care, all furnished by legally authorized providers. States also retain the option to offer additional dental and oral health benefits beyond the mandatory requirements. To incentivize states, the bill provides a substantial financial boost through an increased Federal Medical Assistance Percentage (FMAP) . For the 50 states and the District of Columbia, the federal government will cover 100% of expenditures for these mandatory services for a 12-quarter period beginning January 1, 2028. U.S. territories will also receive 100% FMAP for 12 quarters once they begin covering these services, with these additional funds explicitly excluded from their existing Medicaid funding caps. The legislation also establishes a framework for improving the quality and equity of adult oral health care. It directs the Secretary of Health and Human Services to develop and publish a core set of adult oral health quality and equity measures, similar to those for child health, within one year. These measures will cover aspects such as utilization, emergency department visits, follow-up care, counseling, and specific treatments for conditions like caries and periodontitis. States will be required to report annually on these measures, disaggregated by various demographic factors to identify and address disparities. Furthermore, the bill mandates a report from the Medicaid and CHIP Payment and Access Commission (MACPAC) within two years. This report will analyze adult oral health coverage, access barriers, and potential solutions across states and territories. Finally, the Secretary of Health and Human Services is tasked with developing an oral health outreach and education program to provide culturally competent information, connect adults to care, educate professionals, and promote good oral health practices.
