The Special Education Administration Protection Act aims to prevent the transfer of functions belonging to the Office of Special Education and Rehabilitative Services (OSERS) from the Department of Education to the Department of Health and Human Services. Specifically, it prohibits the Secretary of Education from procuring services, contracting, or transferring activities related to OSERS functions to HHS. The bill also stipulates that certain provisions of the General Education Provisions Act, the Department of Education Organization Act, and the Economy Act will not apply to the specified OSERS functions, thereby reinforcing the prohibition on new inter-agency transfers. However, an important exception is made for any existing agreements, contracts, or arrangements between the two departments that were already in effect on February 1, 2025, and allows for their subsequent renewal.
