This bill creates new federal offenses aimed at strengthening border security by prohibiting actions that intentionally hinder immigration, border, and customs controls. It specifically criminalizes illicit spotting , defined as knowingly transmitting the location or activities of any law enforcement agency with the intent to further federal crimes related to immigration, customs, controlled substances, or other border controls. Additionally, the legislation prohibits the knowing and unauthorized destruction, alteration, or damage of federal border control infrastructure, such as fences, barriers, sensors, or cameras, or the construction of structures intended to defeat or evade them. The bill also amends existing law to apply enhanced penalties for carrying or using a firearm during an alien smuggling crime , defining such crimes by reference to specific felonies under the Immigration and Nationality Act. A 10-year statute of limitations is established for these new offenses and certain alien smuggling crimes.
