This bill, known as the REDACT Act, creates a private cause of action for individuals whose sensitive information is improperly released. It specifically targets disclosures made under the Epstein Files Transparency Act , covering personally identifiable information , personal, or medical files of victims. Such disclosures must constitute a clearly unwarranted invasion of personal privacy to trigger the cause of action. An aggrieved person may bring a civil action against the United States if the violation was committed by a federal officer, employee, or agent. Successful plaintiffs can be awarded the greater of $50,000 in statutory damages or compensatory damages, including for pain and suffering and emotional distress. The bill also provides for reasonable attorney's fees, litigation costs, and appropriate injunctive or declaratory relief, including a waiver of sovereign immunity and a 5-year statute of limitations from the date of actual notice of the violation. These provisions apply to violations occurring on or after November 19, 2025.
