The Form 5500 Filing Simplification Act aims to streamline the reporting process for employee benefit plan administrators. It significantly extends the deadline for filing Form 5500 and other annual reports required under the Employee Retirement Income Security Act of 1974 (ERISA). Specifically, the bill amends ERISA to change the filing period from within 210 days or 6 months to 9 months and 15 days after the close of the plan year. This extension includes provisions for a later filing time if a plan is affected by a disaster, fire, or other qualifying event as defined in the Internal Revenue Code. Furthermore, the legislation directs the Secretaries of Treasury and Labor, along with the Director of the Pension Benefit Guaranty Corporation, to modernize filing statements to allow for electronic signatures. Plans can rely on good-faith compliance until these electronic signature modifications are fully implemented, and the Secretary of Labor is authorized to issue necessary regulations to carry out these changes.
