Servicemember Residence Protection Act of 2026

This bill aims to safeguard the real property of uniformed servicemembers from adverse possession claims while they are fulfilling their military duties. It achieves this by amending the Servicemembers Civil Relief Act to explicitly exclude any period of military service when computing the time required for adverse possession of a servicemember's real property. This crucial amendment effectively tolls the period of adverse possession , ensuring that servicemembers do not lose their property due to "squatter's rights" while they are away serving the nation. Furthermore, the legislation directs the Secretary of Veterans Affairs, in collaboration with the Attorney General, to update Department of Veterans Affairs websites. These updates will provide comprehensive information and resources to servicemembers on how to secure their real property, navigate leasing, and understand their landlord-tenant rights and obligations during their military service.
