This bill prohibits the Secretary of Veterans Affairs from transmitting a beneficiary's personally identifiable information to the Department of Justice for the National Instant Criminal Background Check System (NICS) . This restriction applies when the sole reason for such transmittal is the VA's determination to appoint a fiduciary to manage the beneficiary's benefits under section 5502 of title 38, United States Code. The legislation ensures that a veteran's information is not automatically shared with NICS based solely on a fiduciary appointment. Such information can only be transmitted if a judge, magistrate, or other judicial authority of competent jurisdiction issues an order or finding that the beneficiary is a danger to themselves or others, thereby requiring a judicial determination for such action.
