This bill significantly increases transparency regarding foreign intelligence surveillance activities, particularly those conducted under Section 702 of the Foreign Intelligence Surveillance Act (FISA). It mandates the public release of a specific Foreign Intelligence Surveillance Court (FISC) opinion dated March 17, 2026, related to Section 702 certifications, within 14 days of enactment, with necessary redactions. The legislation requires the Attorney General to submit annual reports to Congress detailing the number of requests for, approvals/denials of, and actual sensitive queries conducted under Section 702, disaggregated by specific categories. Furthermore, it compels the Director of National Intelligence (DNI) to conduct declassification reviews and make publicly available, within 180 days of issuance, all significant decisions, orders, and opinions from the FISC or Foreign Intelligence Surveillance Court of Review. These significant documents include those with novel legal interpretations, those involving sensitive investigative matters such as activities of domestic public officials, political candidates, religious organizations, or the news media, and those nominated for review by an amicus curiae. The bill also mandates the public availability of DNI reports on violations of law or executive order on an internet website, including retroactive publication of past reports, and requires the Attorney General to provide a specific report on FISA violations to Congress. Finally, to enhance transparency regarding intelligence activities outside of FISA, the bill requires an estimate of the number of United States person search terms and queries used by intelligence community elements to retrieve information acquired under Executive Order 12333. The bill also includes a short-term extension, moving the sunset date for Section 702 of FISA from June 12, 2026, to July 17, 2026 .
