This bill aims to enhance national security by prohibiting the entry of certain connected vehicles into the United States. The prohibition applies to vehicles whose country of origin is a designated foreign adversary, such as China, Russia, North Korea, or Iran, or if their manufacturer is significantly owned or controlled by entities from these countries. An exception is provided for vehicles not intended for public roads and imported solely for testing and evaluation by qualified U.S. entities. The bill also establishes a mechanism for the Commissioner of U.S. Customs and Border Protection, in consultation with the Secretary of Commerce, to issue authorizations for vehicles that would otherwise be prohibited. Such authorizations require a determination, based on clear evidence and a risk assessment, that the vehicle poses no undue risk to national security, including risks of data exfiltration or remote manipulation. Before an authorization takes effect, Congress must be notified and has 60 days to disapprove it. The Secretary of Commerce is mandated to publish and maintain a list of all authorized connected vehicles, detailing why each vehicle does not pose a risk. Furthermore, the Commissioner must establish a procedure by January 1, 2027, for manufacturers to seek these authorizations. Regulations implementing these prohibitions, including a list of prohibited vehicles and a public dissemination plan, must be issued within 90 days of enactment, with the prohibition taking effect 30 days after their publication.
