This legislation, known as the "CLOSE THE GAP Act," seeks to significantly modernize and streamline the permitting process for broadband infrastructure on Federal land. It requires the Secretaries concerned to promulgate regulations within one year to ensure a uniform, standardized, competitively neutral, and nondiscriminatory application process across all applicable organizational units. These regulations will also mandate that cost recovery fees are calculated annually based solely on incurred costs and provide for minimum lease terms of not less than 30 years for communications facilities. To further expedite deployment, the bill establishes new categorical exclusions from environmental review requirements for projects that improve public safety at existing communications facilities, such as providing backup power or improving supporting infrastructure. It also exempts applications for communications use authorizations from certain environmental and historical reviews if the equipment is located on existing infrastructure or on previously analyzed Federal land . This includes not requiring reinitiation of consultation even if new information becomes available for previously analyzed land. The bill mandates the establishment of online portals for submitting applications using an electronic SF-299 and standardized procedures for tracking application data. This data will include the number of applications pending, approved, denied, or withdrawn, along with average processing times. A report analyzing this data and providing recommendations to accelerate broadband permitting will be submitted to Congress. Furthermore, the legislation requires the Treasury to establish special accounts for Federal land management agencies to deposit and retain cost recovery fees. These funds are specifically designated for activities related to communications use authorizations and sites, including administration, needs assessments, and personnel training to streamline permitting. Finally, it establishes a Federal Land Management Agency Working Group to coordinate and expedite the review of applications and to collaborate with the FCC on identifying unserved locations that may require Federal rights-of-way.
