A copy of this agreement must then be provided to any employer, plan sponsor, or fiduciary who may be directly and adversely impacted by the assistance. EBSA will also be required to submit an annual report to Congress detailing all such adverse assistance agreements in effect during the preceding fiscal year. This report must include a copy of each agreement, a detailed description of the assistance provided, including information shared and logs of communications and meetings, and an explanation of how the agreement aligns with the public policy of promoting voluntary employee benefit plans. While the report must identify the parties to the agreement, it cannot include information that identifies other individuals or entities who might be potential defendants. Finally, the bill amends ERISA's declaration of policy to explicitly state that Congress finds the retirement security of millions of employees is directly impacted by the voluntary sponsorship and maintenance of pension plans. It declares that a policy of ERISA is to promote, encourage, and facilitate the voluntary establishment and maintenance of, and contribution to, such plans.
