The ePermit Act seeks to significantly improve federal environmental reviews and authorizations by transitioning to modern digital platforms. Congress finds that current processes suffer from coordination issues, lack of transparency, and inefficiencies, hindering timely project completion. By embracing digital strategies, the bill aims to make community engagement more accessible and ensure data integrity, ultimately reducing costs and enhancing public service. To achieve this, the Council on Environmental Quality (CEQ) is tasked with developing and updating data standards for authorization data within 60 days of enactment. These standards will organize, define, and standardize various concepts and formats, reducing redundant reviews and supporting vendor neutrality and data interoperability. Concurrently, CEQ will design and build prototype tools to assist agencies in managing tasks, milestones, and activities related to environmental reviews and authorizations. Within 120 days, CEQ must publish guidance for federal agencies on implementing these data standards and specific minimum functional requirements . These requirements include automated data sharing, project screening, public availability of screening criteria, and integrated geographic information system (GIS) analysis tools. Other key provisions involve document management tools that preserve metadata and automated comment compilation and analysis, potentially with Artificial Intelligence support. Federal agencies are required to assess their existing systems against these standards and requirements within 90 days and begin implementation within 180 days. The bill mandates the iterative development and maintenance of a unified interagency data system , which will include a common interactive, digital, cloud-based authorization portal . This portal is designed to track real-time data, facilitate information exchange, and allow project sponsors to submit all necessary documentation securely. The authorization portal will support interactive tools for collaboration, visual features like GIS displays, and automatic documentation of timelines. It will also track various metrics, including efficiency gains, authorization timelines, and public engagement. The portal will be hosted by the General Services Administration and accessible to Congress, federal agencies, and the public, with safeguards for sensitive information and robust cybersecurity measures. CEQ must oversee the piloting of shared services, including the authorization portal, within one year, with the unified system to be developed and implemented by December 1, 2027. The bill grants CEQ authority to enter into contracts for necessary analyses and services. Importantly, it clarifies that the Act does not authorize CEQ or federal agencies to impose additional regulatory processes beyond existing laws like the National Environmental Policy Act.
