This bill amends Section 628A of the Tariff Act of 1930 to significantly expand the sharing of information concerning suspected violations of intellectual property rights in trade. It revises the standard for information sharing from merely "suspects" to requiring a "reasonable suspicion" of a violation, clarifying the threshold for action by U.S. Customs and Border Protection (CBP). The legislation broadens the scope of merchandise covered to include packing materials and shipping containers , in addition to the goods themselves. Furthermore, it authorizes CBP to share nonpublic information generated by online marketplaces, express consignment operators, freight forwarders, or other entities involved in the sale or importation of merchandise, provided CBP has obtained this information. Finally, the bill expands the potential recipients of this shared information to include any other party with an interest in the merchandise , as deemed appropriate by the Commissioner.
