This bill, known as the "Compressed Gas Cylinder Safety and Oversight Improvements Act of 2025," directs the Secretary of Transportation to establish new regulations for foreign manufacturers of cylinders (FMOCs) . These regulations specifically target cylinders intended for transporting hazardous materials in commerce within the United States. The legislation aims to enhance the safety, compliance, and oversight of these foreign-produced containers. The bill mandates that approvals for FMOCs will generally be valid for a period of no longer than one year. However, a five-year approval may be granted if the FMOC attests that its cylinders are not prohibited from U.S. entry, certifies the accuracy of provided information, and is determined by the Secretary to be "in good standing." An FMOC achieves "in good standing" status by being approved by the Secretary and demonstrating three years of compliance with specific federal regulations and statutes. To increase transparency and accountability, the Secretary must publish notifications of FMOC approval applications on the Pipeline and Hazardous Materials Safety Administration website, allowing for a 30-day public comment period. Applicants will also be required to answer additional questions regarding their compliance history, including past penalties, delinquency, and status on various government watchlists. The Secretary holds the authority to deny an application based on these responses or to suspend or terminate an approval for knowing misrepresentation or obstruction of inspections. The legislation strengthens inspection authority by requiring the Secretary to revise regulations to mandate annual inspections when there is good cause and to allow for the recovery of associated inspection costs. Refusal to permit an inspection will result in the loss of an FMOC's "in good standing" status. Furthermore, the bill requires the Secretary to establish a process for interested parties to request a reevaluation of an FMOC's approval, particularly if there is evidence of inaccurate, changed, or fraudulent attestations made by the manufacturer.
