This legislation, known as the "No Adversarial AI Act," directs the Federal Acquisition Security Council (FASC) to develop and regularly update a list of artificial intelligence (AI) produced or developed by foreign adversaries . The Office of Management and Budget (OMB), in coordination with the FASC, is required to publish this list publicly within 180 days of the Act's enactment, with updates occurring at least every 180 days thereafter. The bill prohibits executive agencies from acquiring or using AI included on this list, requiring them to review and consider for exclusion or removal such AI within 90 days. However, it establishes specific exceptions for purposes such as scientifically valid research , evaluation, training, testing, analysis, counterterrorism, or counterintelligence activities. An exception may also be granted to avoid jeopardizing mission-critical functions , provided the agency head provides written notice to OMB and appropriate congressional committees.
