This bill immediately suspends the Secretary of Education's authority to administratively garnish wages for student loan debt, with the suspension lasting at least one year. The Secretary must then certify to Congress either that a new, reformed garnishment process is fully implemented or that the garnishment program will no longer apply to individuals, a prerequisite for any future garnishment activities. The required reforms are extensive, including ensuring improperly garnished funds are refunded within one calendar week , granting the Secretary independent discretion to cease or suspend garnishment for individuals or cohorts, and mandating quarterly employer verification of garnishment accuracy and employee information. If these reforms are certified, a centralized database of garnished individuals' demographic data must be established, with annual reports to Congress. The legislation also introduces new protections for borrowers, making employers liable for improperly withheld wages after a suspension notice. It requires the Department to pay borrowers twice the amount of any improperly garnished wages within 10 days of receipt, and explicitly prohibits garnishing wages for any student loan that has been outstanding for more than 10 years .
