Shivwits Band of Paiutes Jurisdictional Clarity Act

This bill aims to clarify and expand civil jurisdiction over matters involving the Shivwits Band of Paiutes and their Indian lands. It specifically grants the State of Utah civil jurisdiction for any cause of action where the Shivwits Band is a party and the action arises on or within their designated Indian lands. Furthermore, the legislation establishes federal court jurisdiction for disputes related to contracts or agreements affecting these Indian lands or involving the Shivwits Band, classifying them as matters of "commerce" and arising under federal law. Importantly, the Act explicitly states that it does not abrogate the sovereign immunity of the Shivwits Band of Paiutes from unconsented suit, nor does it diminish their authority to waive such immunity. Finally, the bill amends existing law to include land held in trust for the Shivwits Band of Paiutes within the scope of certain leasing authorities , thereby updating their ability to manage their trust lands.
