Businessowner Immigration Rights and Responsibilities Information Act of 2026

This bill amends the Small Business Act to mandate the creation of comprehensive **educational resources** for small business owners and their employees regarding **immigration enforcement**.

The Small Business Administration (SBA) Administrator will be required to establish and maintain educational modules, a concise card, and compliance and planning materials. These resources will inform individuals about their **rights and responsibilities** during or after an attempted or anticipated immigration enforcement action on business premises, or in the event of an arrest or detention.

Key information provided will include instructions on how to respond to enforcement agents, such as remaining calm, exercising the **right to remain silent**, and demanding a signed **judicial search warrant** for private areas. It will also cover the **right to legal counsel**, how to contact Members of Congress for assistance, and best practices for preparing for potential enforcement actions.

Furthermore, the materials will detail the responsibilities of small business owners to comply with applicable immigration and **work authorization regulations** when vetting employees, and how to prepare for **I-9 audits** and employer sanctions. All resources will include a **disclaimer** that they are for informational purposes only and not legal advice, directing users to seek an attorney for specific legal guidance.

The SBA is tasked with making these resources publicly available on its online platforms and through regional and district offices, including physical distribution. To ensure accuracy and currency, the Administrator must consult with relevant federal agencies and experts, and update materials in response to changes in immigration laws. Importantly, the information will be translated into the **15 most commonly spoken languages** in the United States, including Spanish and Chinese, as well as American Sign Language, and must be established within 180 days of the bill's enactment.
