The "Swatting Registry Best Practices Act" directs the Attorney General, in consultation with the Secretary of Homeland Security, to develop and issue comprehensive guidance within one year. This guidance will provide best practices for State, Tribal, territorial, and local governments and public safety agencies regarding the establishment, operation, and oversight of voluntary swatting registries and related public safety protocols. The Attorney General must consult with a broad range of stakeholders, including law enforcement, public safety experts, privacy advocates, and victims of swatting. Key elements of the guidance will cover program design, necessary data elements with an emphasis on data minimization , and integration of registry information into call-taking and dispatch workflows. It will also address officer safety and training, ensuring appropriate use of registry data while avoiding overreliance on unverified information. The guidance will detail best practices for privacy, civil rights, and civil liberties protections , including voluntary participation, restricted access, encryption, and audit logging. It will also cover data retention, accuracy, and governance, along with recommendations for technology, interoperability, and potential federal funding. Participation in these registries must be voluntary and based on informed consent, with mechanisms for registrants to update or delete their information. The Act clarifies that it does not authorize a federal swatting registry, nor does it require any jurisdiction to establish one. It also ensures the guidance does not limit the discretion of responding law enforcement officers to protect life and public safety. The Attorney General is authorized to provide technical assistance and use existing grant programs to support jurisdictions implementing these best practices.
