Weaponization Offender Claims Ban Act of 2026

This legislation, titled the Weaponization Offender Claims Ban Act of 2026 , amends section 2680(h) of title 28 of the United States Code to impose additional limitations on the intentional tort exception. Its primary purpose is to restrict the ability of certain private individuals to bring claims under this exception. Specifically, the bill stipulates that a private individual cannot bring such a claim if they have been convicted of a range of offenses, even if pardoned or had their sentence commuted. These disqualifying convictions include assault or battery against a Federal law enforcement officer , offenses related to interference with Federal elections , or obstruction of a Federal governmental process . Furthermore, individuals convicted of any felony offense involving confrontation with a Federal law enforcement officer or certain felonies related to theft, misuse of Federal funds, or obstruction of Federal oversight activities are also barred from bringing these claims.
