Modernizing Opioid Treatment Access Act 2.0 of 2026

The Modernizing Opioid Treatment Access Act 2.0 of 2026 aims to significantly expand access to methadone for individuals with opioid use disorder (OUD). It achieves this by amending the Controlled Substances Act to create an alternative care model for methadone prescribing and dispensing, moving beyond the traditional opioid treatment program (OTP) framework. Specifically, the bill allows certain qualified practitioners , such as board-certified addiction medicine physicians or psychiatrists, to prescribe methadone for OUD. This methadone would then be dispensed directly through pharmacies for patient use, either supervised or unsupervised. Prescriptions must be issued electronically and be for liquid or dispersible tablet formulations of methadone. This new pathway is intended to be in addition to, rather than a replacement for, care received through existing OTPs. Practitioners must ensure and document informed consent , including differences in confidentiality protections compared to OTPs. States retain the ability to opt out of this program, and the Drug Enforcement Administration (DEA) is mandated to submit annual reports to Congress detailing its implementation, including practitioner registrations and any revocations.
