HOLDBACKS Act

This legislative proposal aims to enhance transparency in the primary ticket market and prevent deceptive pricing practices. It requires primary ticket sellers to publicly disclose crucial information, such as the total number of scheduled occurrences and the exact quantity of tickets available for general public sale, at least seven days before tickets are first offered. The bill further mandates that sellers clearly display the total cost of an individual ticket , encompassing all fees and charges, to ensure consumers are aware of the final price upfront. A key provision prohibits primary ticket sellers from withholding tickets from public sale with the intent to inflate prices beyond fair market value or to mislead consumers about actual ticket availability. The Federal Trade Commission is empowered to enforce these provisions, treating violations as unfair or deceptive acts or practices, while also preserving the authority of state attorneys general to pursue related actions.
