Drug Deal Disclosure Act

This bill mandates the public disclosure of private or confidential drug pricing deals between federal entities and drug manufacturers. The Department of Health and Human Services (HHS) must release all records, documents, and communications related to agreements made on or after January 20, 2025, in a centralized, searchable, and downloadable format. These agreements encompass those involving reduced drug prices referencing foreign prices, direct-to-consumer sales, import duty exemptions, manufacturer investments in the U.S., special treatment in Medicare/Medicaid innovation models, contributions to the Strategic National Stockpile, or priority review vouchers. The legislation specifically lists 17 drug manufacturers whose publicly announced agreements, dating from late 2025 to early 2026, are subject to this disclosure. Furthermore, any new or modified agreements meeting the specified criteria must also be disclosed within 30 days of ratification. While disclosure cannot be withheld for reputational harm or political sensitivity, proprietary pricing information or legally protected data may be redacted, provided HHS offers a written justification published in the Federal Register and submitted to Congress. Following the release of these agreements, HHS must submit a report to Congress detailing all released and withheld information, including the legal basis for any redactions. Additionally, the Congressional Budget Office (CBO) and Government Accountability Office (GAO) are required to jointly analyze the economic and budgetary effects of all disclosed agreements. This analysis must cover direct cost savings for individuals, impacts on Medicare and Medicaid programs, and effects on drug price competition and health plan formulary design.
