This bill, known as the "Online Accessibility Act," amends the Americans with Disabilities Act of 1990 to extend non-discrimination protections to individuals with disabilities using consumer-facing websites and mobile applications operated by private entities. It mandates that these digital platforms achieve substantial compliance with the Web Content Accessibility Guidelines (WCAG) 2.0 Level A and Level AA standards, or provide an alternative means of access for equivalent content. The Access Board is directed to define key terms and issue implementing regulations within 365 days, ensuring flexibility for small business concerns . Concurrently, the Attorney General must establish a procedure for receiving and investigating complaints regarding non-compliance. Individuals must exhaust administrative remedies before filing a civil lawsuit, beginning with a 60-day notice to the non-compliant entity. If unresolved, a complaint can be filed with the Department of Justice, which then has 180 days to investigate. The Attorney General can initiate civil actions for patterns of discrimination, seeking equitable relief, monetary damages, and civil penalties up to $50,000 for repeat violations. A private right of action is permitted only after administrative remedies are fully exhausted and if the Attorney General has not already commenced an enforcement action, requiring specific pleading of the barriers to access.
