No Medicare Clawbacks Act of 2026

This bill amends the Social Security Act to prevent group health plans from recouping payments made for services under specific circumstances. The legislation targets situations where an individual is entitled to Medicare benefits, particularly when Medicare Part A coverage is applied retroactively . Specifically, if a group health plan initially pays for an item or service without considering the individual's Medicare entitlement, it is prohibited from later recouping that payment solely because the individual was retroactively covered by Medicare. This protection applies only if the service was furnished during the period of retroactive Medicare Part A coverage and the individual was not delinquent on their employee contributions to the group health plan at the time of service.
