Protect Seniors and Veterans from Health Care Fraud Act of 2026

This bill mandates the Secretary of Veterans Affairs (VA) to enter into a Memorandum of Understanding (MOU) with the Secretary of Health and Human Services (HHS) within one year of enactment. The primary goal of this MOU is to prevent duplicative, improper, or erroneous billings or payments for hospital care and medical services provided to veterans under VA laws. The MOU will establish reciprocal access to health care data between the Veterans Health Administration and the Centers for Medicare and Medicaid Services (CMS). This data sharing will focus on veterans who are concurrently enrolled in the VA patient enrollment system and either the Medicare program, the Medicaid program, or a Medicare Advantage plan. Under the agreement, the VA will transmit information on veterans receiving care, including billing and diagnostic codes, to HHS. In turn, HHS will use this data to identify dually enrolled veterans and provide a list back to the VA. The MOU will be effective for a two-year period, and the VA Secretary must report to Congress on its activities and effectiveness in preventing improper payments.
