Fair Telehealth Billing Act of 2026

This bill amends the Employee Retirement Income Security Act of 1974 (ERISA) to regulate billing practices for telehealth services. Its primary purpose is to prevent health care providers and facilities from imposing separate facility fees when delivering telehealth services. Specifically, it prohibits such fees if the health care provider is already authorized to bill independently for the professional services rendered during the telehealth encounter. To ensure compliance, the Secretary of Labor is granted authority to assess a civil monetary penalty of up to $10,000 for each violation found. These provisions will apply to telehealth services furnished on or after January 1, 2028, with implementation to be carried out through rulemaking by the Secretary of Labor.
