Governors’ Right to Inspect Act of 2026

This bill, titled the "Governors' Right to Inspect Act of 2026," aims to authorize state Governors and their designated public health or safety officials to conduct health and safety oversight inspections of immigration detention facilities located within their states. These facilities include those operated by U.S. Immigration and Customs Enforcement (ICE), private contractors, or state/local governments under federal contract. The purpose is to ensure humane treatment and adequate conditions, covering aspects like sanitation, medical care, food quality, and sleeping conditions, without interfering with federal immigration enforcement operations.

Authorized oversight officials will have the right to access all areas where detainees are housed, speak privately with detainees on a voluntary basis, and review relevant health and safety records. Governors may conduct inspections without prior notice, while designated state officials must provide 24-hour advance notice. Following an inspection, Governors have the option to submit a written report to various congressional committees, detailing observations and recommendations. The Secretary of Homeland Security will then have 60 days to provide a public response to any identified deficiencies. If access is denied, Governors can pursue civil action in federal court to affirm their right to inspect.
