No Toxic Chemicals in Food Packaging Act of 2026

This bill amends the Federal Food, Drug, and Cosmetic Act to declare numerous substances as unsafe for use as food contact substances. It explicitly prohibits all chemicals belonging to the class of ortho-phthalates and PFAS (per- and polyfluoroalkyl substances). Additionally, specific compounds such as Bisphenol A, B, S, F, or AF, Acrolein, Acrylamide, BHA, Chlorinated paraffins, 1,4-Dioxane, Asbestos, Benzene, Chloroform, Methylene chloride, Ethylene oxide, Formaldehyde, and Styrene polymers are deemed unsafe for use in materials that come into contact with food.

When evaluating alternative food contact substances, the Secretary must consider potential adverse effects on vulnerable populations, including infants, children, pregnant women, and the elderly. The legislation also explicitly preserves State and local authority, allowing them to enact and enforce more stringent laws regarding food additives than federal requirements. These provisions will apply two years after the Act's enactment, providing a transition period for compliance.
